Many private trackers have membership fees or charge $ if you dont keep an upload ratio etc

The only "spirit" behind torrents is that you upload equally as much as you download, if not more, since torrents are only useful if everyone else continues to share. Charging memberships and making torrents private prevents abuse by leeches. It's no different than private newsgroups, irc channels, etc.
